These terms cover the terms of use of; our website www.5k2pb.com, our online learning platform www.5k-2-pb.thinkific.com, our blog and our posted social media content.  These terms and conditions must be agreed to prior to purchase. We recommend that you print a copy of this for future reference. 


INTELLECTUAL PROPERTY RIGHTS, SHARING AND USE
We are the owner or the licensee of all intellectual property rights in our sites, and in the materials published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. The services provided are for your own personal use only. You cannot provide access or copy material for any other person. You may not sub-license, translate, merge, adapt, alter, vary or modify any of 5k2PB ltd’s content. You acknowledge that all intellectual property rights in the 5k2PB website and Running Academy, belong to its licensor, that rights are licensed (not sold) to you, and that you have no rights in, or to, 5k2PB ltd other than the right to use information provide to you for you own Personal use.

We do not guarantee that our programme, site, or any other content, will be free from errors or omissions. 

 

APPROPRIATENESS OF HEALTH AND FITNESS TO COMMENCE A 5k2PB PROGRAMME OR ANY SUGGESTED ACTIVITY OR CHALLENGES
The 5k2PB Running Academy, Personalised Programmes and any suggest activity or challenges on our website, blog and social media posts require you to exert yourself, potentially greater that you are currently used to. You must therefore have an appropriate base level of fitness (used to regular exercise and/or able to run 5km comfortably) prior to commencing. Regardless of your fitness ability we recommend that you seek medical advice before commencing the any activity, programme or challenge suggested by 5k2PB.

We recommend that you are aware and familiar of any running routes that you chose to train, in particular, you should know any hazards and dangers. As you exert yourself your body and concentration is likely to fatigue and therefore take extra care of your surrounds during the more demanding sections.
The following self-pre-exercise medical screening should be completed by yourself, this is a mandatory module on the 5k2PB Running Academy, if you answer yes to any of the following questions the programme may not be suitable for you. Please seek medical advice specifying the questions you answered yes for.
Self-Pre-Exercise Medical Screening 1. Do you have a history of heart problems? 2.Do you have a history of lung problems? 3.Have you had chest pains or tightness in the chest? 4.Do you suffer from exercise induced asthma or other respiratory problems? 5.Do you suffer from headaches/fainting/ dizziness? 6.Do you have pain/limited movement in any joint that could be made worse by a change in your physical activity? 7.Do you have diabetes? 8.Do you have epilepsy? 9.Have you had a recent operation/chronic illness/injury? 10.Are you pregnant / post-natal? 11.Do you know of any other reason why you should not do physical activity? 12.Is there a history of heart problems in your family? 13.Do you have high blood pressure? 14.Do you have a back problem that could be made worse by a change in your physical activity? 15.Do you smoke? 16.Are you currently taking any medication? 


By agreeing to these terms and conditions you are agreeing to the following statements: 

 

·        My state of health and physical condition is such as not to involve any risk to myself and I have an appropriate level of fitness (regular exercise, able to run 5km) to commence and complete the 5k2PB plan/programme.

·        I am aware of and understand the potential risks associated with physical exercise and I am voluntarily partaking in these activities with knowledge thereof. 
 

·        I have sought medical advice and confirm I am fit to proceed with the physical exercise prescribed. 
 

·        I am aware and understand that my body and concentration will fatigue during exercise and have ensured I am aware of the routes to run and risk assessed the route for hazards and dangers. 
 

·        I will complete the self pre-exercise medical screening question to the best of my knowledge and belief and confirm that there is no reason why I cannot commence the physical exercise prescribed. 
 

·        I understand that if there is a change in my condition at all, I must stop following the plan/programme immediately. 
 

Without prejudice to the above, 5k2PB accepts no liability for loss, damage or injury of whatsoever nature and howsoever arising caused to me or suffered by me whilst following any 5k2pb plan/programmes, activities or challenges, UNLESS such loss or liability is caused by a negligent act of 5k2PB. 



LIMITATION OF OUR LIABILITY
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
1. use of, or inability to use, our site and 5k2pb pdf; or
2. use of or reliance on any content displayed on our site or 5k2pb. 

 

SUBSCRIPTIONS

When you enter into a Subscription with us, you will be granted access to the Subscription Only Areas of the Website (Full Member Access) for the term of your Subscription (4 or 12 weeks).

Your subscriptions will renew until terminated. You may terminate a subscription any time through your user account or  contact us on [email protected]

Your access constitutes a non-exclusive, non-transferable, limited right to access, use and display on your personal devices the content published in the subscription only Areas, including coaching videos, nutrition posts and recipes by other users.

The Subscription Content is for your personal, non-commercial use only. You may not assign, transfer or sublicense any of these rights or publish, share, any Subscription Content to any other person or third party or modify any Subscription Content, or attempt to do any of these things. If you fail to comply with the restrictions in this, we may cancel or terminate your Subscription without prior notice or liability to you. 

 

 

VIRUSES
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. The online community is currently based in a private Facebook group. We are not responsible for any breaches to this platform. Therefore, you join Facebook and the group under your own risk. We reserve the right to change the tool we use at any time.

The group is designed to provide accountability and support. We expect you to also contribute and provide both to other members, although it is not mandatory to contribute. Within the group you must conduct yourself in well-mannered fashion at all times. We may revoke your access to the group immediately should you harass, threaten or abuse 5k2PB (including their staff) or other members of the group. We reserve the right to remove the group at any time without prior warning if we feel you contribution is inappropriate.  If your access is revoked no refunds will be provided.

We may reasonably revise these Terms from time to time. We will endeavour to provide you with reasonable advance notice where this is appropriate due to the nature of the revision. We will notify you on the website or via email.
